SUPREME COURT ON 13.03.2018 EXTENDS DEADLINE OF 31.03.2018 FOR MANDATORY LINKAGE OF AADHAAR WITH BANK ACCOUNTS, MOBILE AND PAN TILL THE DISPOSAL OF AADHAAR CASES

There is good news for all those who have still not linked their Aadhar with bank accounts and mobile. The order passed by the Supreme Court dated 13.03.2018 came as relief over the uncertainty that whether the deadline for linking of Aadhaar would be extended beyond March 31 st , 2018.

The Constitution Bench is hearing challenges to the constitutional validity of the Aadhaar scheme on the touchstone of the fundamental right to privacy on a bunch of petitions by former Karnataka High Court Judge K S Puttuswamy, Magsaysay Awardee Shanta Sinha, feminist researcher Kalyani Sen Menon, and others.

The Supreme Court on 13.03.2018 extended the interim order dated 15.12.2017 deadline of March 31 st for mandatory linking of Aadhaar to bank accounts, PAN, mobile and avail various services and welfare schemes run by the government till its constitution bench delivered its verdict on the validity of the 12-digit biometric number and its enabling law.

A five-judge Constitution bench headed by Chief Justice Dipak Misra along with Justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan extended the deadline after the Centre said it had already submitted that they were ready to extend the March 31 deadline for linking of the national biometric identifier with all services and welfare schemes.

The Supreme Court said that the March 31, 2018, deadline for linking of Aadhaar with various services and welfare schemes stand extended till the matter is heard and judgement is pronounced by the constitution bench. The extension of deadline would also apply on the mandatory linking of Aadhaar with the bank accounts and mobile phone numbers. The UIDAI, however, has said the requirement of Aadhaar for opening new bank accounts or applying for Tatkal passports will continue, while the deadline for linking it to existing bank accounts, PAN and mobile numbers has been extended by the Supreme Court.

Supreme Court order dated 13.03.2018 summarized in four points:

  1. The deadline for linking Aadhaar with mobile phones, bank accounts and PAN has been extended;
  2.  The Supreme Court said that its interim order will remain in force till further verdict;
  3. The apex court had last year extended the deadline to March 31 st , 2018. This deadline is further extended till judgment;
  4. The government cannot insist for mandatory Aadhaar even for issuance of Tatkal passport;

The order makes it clear that one does not have to link the Aadhar with bank accounts, PAN and mobile numbers until the Supreme Court passes its final verdict in the case. So, for now, you can continue to ignore those messages and if forced by banks and service providers, consumers can refer to the below mentioned statement:

 

As per the Supreme Court order dated 13.03.2018 Writ Petition (Civil) No. 494/2012, the deadline of 31.03.2018 to link Aadhar with bank account, PAN and mobile numbers is extended till the final verdict of Supreme Court.

    Is it really mandatory to provide Aadhar to open new bank account or demat account?

    Link Adhar with various accounts .
